Terms & Conditions
Any goods which you purchase from Granary Foods will be subject to these Terms and Conditions. By placing an order with us, you agree to be bound by our Terms and Conditions.
1. Definitions
- 1.1 "You" and "your" means the customer ordering goods from Granary Foods.
- 1.2 "Granary Foods" or "we", "us, or "our" means Granary Foods, whose address is at: James Place, 4 James Terrace, Newton le Willows, Bedale, North Yorkshire. DL8 1SQ.
- 1.3 "Website" means the website at www.granaryfoods.co.uk.
2. Orders
- 2.1 Orders can be place with us by telephone, post, e-mail, or by visiting us at our website.
- 2.2 Any order which is placed by you shall specify the goods required, a delivery address and an agreed date for delivery to take place.
- 2.3 Payment shall be made via cheque, with bank verification, or credit/card upon you placing an order with us. From that point, you have entered into a legally binding contract with us.
- 2.4 A confirmation of your order, containing the details specified at clause 2.2 above, will be sent to you as soon as is reasonably possible after receipt of your order.
- 2.5 All orders are subject to availability.
3. Price
- 3.1 The prices of our goods, which are specified on our website and in our brochure, are correct at the time of posting/print. We reserve the right to amend these prices at any time.
- All prices include delivery, with a minimum invoice value of £30.00.
- Where applicable, all prices include any Value Added Tax.
4. Unavailable Goods.
- 4.1 We reserve the right to replace any aspect of your order with a suitable alternative if we are unable, for any reason to produce the goods ordered and you will be refunded where appropriate, if the value of the goods is less.
5. Delivery
- 5.1 As per clause 2.2, dates and places for delivery will be agreed upon order. We will make every effort to deliver by 1700 hours on the agreed date.
- 5.2 We reserve the right to restrict deliveries in certain areas and this includes the right to eliminate certain areas from our delivery schedule entirely.
- 5.3 You should consult us to confirm whether you are within our delivery area each time you place an order with us.
- 5.4 We will make every effort to deliver your order to the address specified, and at the time agreed
- 5.5 In the event of this not being possible, we shall return the goods to our premises, where they shall be made available for your collection, or for a re-arranged delivery.
- 5.6 All goods are supplied at a temperature which is appropriate to that food.
6. Cancellation
- 6.1 Cancellation must be undertaken by email or a telephone call to us.
- 6.2 In the event that you wish to cancel your order, the following provisions will apply:
- 6.2.1 Cancellation received at least four weeks prior to delivery will qualify for a full refund, and such refund shall be credited to the payment method used.
- 6.2.2 Cancellation received between two and three weeks prior to delivery will be refunded by a credit note, which must be redeemed within six months of the original delivery date, and within the same delivery area.
- 6.2.3 No refund will be given if the cancellation is received within two weeks of the delivery date
7. Customer Obligations
- 7.1 All main meal orders are only supplied for your own use as a customer, and not for resale.
- 7.2 Any person who is not a party to these terms and conditions will have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce them
8. Exclusions.
- 8.1 We shall always aim to deliver your order within the agreed delivery time; however, we cannot accept liability for the failure to do so.
- 8.2 We shall not be responsible for any loss or damage caused to the goods after delivery.
- 8.3 Notwithstanding clauses 8.1 and 8.2 our entire liability under this contact shall, in any event, be limited to the value of your order only.
- 8.4 Nothing in these Terms and Conditions in any way limit or liability for death or personal injury incurred as a result of our negligence, nor limit your statutory rights.
9. General
- 9.1 These Terms and Conditions are subject to English Law and are the exclusive jurisdiction of the English Courts.
- 9.2 These Terms and Conditions comprise the entire agreement made between you and Granary Foods relating to any orders you may make.
- 9.3 Granary Foods reserves the right to alter or withdraw their service at any time, to refuse the service to any customer and to amend these Terms and Conditions at any time.
